Terms of Service

By accessing or using SagaDeutsch ("the Service", "the Platform"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service. These Terms apply to all visitors, registered users, free-tier users, and paying subscribers.

Description

SagaDeutsch provides an online German language exam preparation platform including mock exams, practice questions, AI-generated listening passages (text-to-speech audio), progress tracking, and educational blog content for Goethe-Institut, TELC, and TestDaF certifications across CEFR levels A1–C2.

Service Availability

We aim for high availability but do not guarantee uninterrupted, error-free, or timely access to the Service. We may modify, suspend, or discontinue any part of the Service at any time. with or without notice. for maintenance, legal compliance, or operational reasons. We are not liable for any loss arising from downtime or service changes.

Beta Features

Some features may be released as beta or experimental. These are provided as-is without warranty and may be changed or removed without notice.

Text-to-Speech Audio

Listening exam passages on SagaDeutsch are narrated using AI text-to-speech technology. specifically Microsoft Azure Neural TTS (via the edge-tts library) and Amazon Polly. The audio you hear during listening exercises is synthetically generated, not recorded by human speakers.

Accuracy Disclaimer

While we use high-quality neural TTS voices, AI-generated audio may occasionally mispronounce words, apply incorrect stress, or produce unnatural intonation. We make no warranty that AI-generated audio is phonetically identical to native speech. This content is provided for exam preparation purposes only.

No AI Evaluation of Your Answers

SagaDeutsch does not use AI to evaluate, grade, or score your written or spoken responses. All automated scoring is rules-based (multiple choice, matching, true/false). We do not make automated decisions about you that have legal or significant effects.

Future AI Features

If we introduce AI features that process your submitted content (e.g. AI feedback on written answers), we will update these Terms and our Privacy Policy and obtain any required consents before such features go live.

Eligibility

You must be at least 16 years of age to create an account. By registering, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.

Account Responsibility

You are solely responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect any unauthorised access to your account.

One Account Per Person

Each person may maintain only one free account. Creating multiple accounts to circumvent access limits or subscription restrictions is prohibited and may result in all associated accounts being terminated.

Account Accuracy

You agree to keep your account information (name, email) up to date. We may suspend accounts where contact information is false or unverifiable.

Free Tier

SagaDeutsch offers a free tier with limited access to mock exams per month. No payment information is required for the free tier. Free-tier limits may change at any time.

Paid Subscriptions

Premium plans are offered on a monthly or annual billing cycle as described on the Pricing page. By subscribing, you authorise SagaDeutsch (or our payment processor) to charge your payment method on a recurring basis at the rate displayed at checkout, until you cancel.

Payment Processing

Payments are processed by a third-party PCI-DSS compliant payment processor. By providing payment information, you agree to that processor's terms. SagaDeutsch does not store your raw card data.

Taxes

Subscription prices shown may exclude applicable taxes (VAT, GST, sales tax). You are responsible for any taxes applicable to your purchase under the laws of your jurisdiction. For EU users, prices displayed include VAT where required by law.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. you retain full access until then. We do not offer prorated refunds for unused time in a billing period.

Refunds

All subscription fees are non-refundable except: (a) where required by mandatory consumer protection law in your jurisdiction; (b) where we have materially failed to provide the Service as described. If you believe you were charged in error, contact [email protected] within 14 days of the charge.

EU/EEA 14-Day Right of Withdrawal

If you are located in the EU or EEA and subscribe to a paid plan, you have a 14-day right of withdrawal from the date of purchase, unless you have already accessed premium exam content during that period (in which case the right of withdrawal is waived by your use of the Service).

Price Changes

We may change subscription prices with at least 30 days' advance notice by email. The new price takes effect at your next renewal after the notice period. Continued use of the Service after a price change constitutes acceptance. If you do not accept the new price, you may cancel before the renewal date.

Failed Payments & Suspension

If a payment fails, we will attempt to notify you and may retry the charge. Accounts with overdue payments may be downgraded to the free tier or suspended until the outstanding balance is resolved.

Prohibited Actions

You agree not to: (a) Share your login credentials or allow others to access the Service using your account. (b) Use automated bots, scrapers, or scripts to access or extract content from the platform. (c) Copy, redistribute, republish, or resell any exam content, questions, audio files, or platform material without prior written permission. (d) Attempt to reverse-engineer, decompile, or disassemble any part of the Service. (e) Use the Service to transmit spam, malware, or any unlawful content. (f) Impersonate any person or entity, or misrepresent your affiliation with any person or entity. (g) Circumvent access controls, session limits, device limits, or subscription restrictions. (h) Use the Service for commercial tutoring, resale, or white-labelling without a separate written agreement. (i) Interfere with the Service's infrastructure or other users' access.

Consequences

Violation of these terms may result in immediate suspension or permanent termination of your account, without refund, at our sole discretion. We reserve the right to pursue legal remedies for material breaches.

SagaDeutsch Content

All platform content. including exam questions, listening passages and their audio recordings, scoring logic, interfaces, logos, brand assets, blog articles, and written material. is owned by or validly licensed to SagaDeutsch. These are protected by copyright, trademark, and other applicable intellectual property laws.

Restrictions

You may not reproduce, distribute, publicly display, create derivative works from, or exploit any platform content outside of your personal exam preparation without prior written permission from SagaDeutsch.

Third-Party Exam Formats

SagaDeutsch prepares users for Goethe-Institut, TELC, and TestDaF exams. These certification bodies own their respective trademarks and official exam content. Our mock exams are independently created to mirror official formats. they are not official materials from, endorsed by, or affiliated with Goethe-Institut e.V., TELC GmbH, or the TestDaF-Institut. The use of these names is descriptive only ("preparation for Goethe exams").

Your Content

You retain ownership of any written answers or responses you submit during exams. By submitting, you grant SagaDeutsch a limited, non-exclusive, royalty-free licence to store, process, and analyse that content solely to provide the Service (e.g. calculate scores, display your history). We do not use your exam responses for training AI models or sharing with third parties.

Feedback

If you submit feedback, suggestions, or feature requests, you grant us a perpetual, royalty-free licence to use them without obligation or compensation to you.

Integrated Third-Party Services

SagaDeutsch relies on third-party services to operate: Amazon Web Services (hosting), Vercel (frontend delivery), Cloudflare R2 (media storage), Microsoft Azure Cognitive Services (TTS audio), Amazon Polly (TTS audio), and a payment processor (disclosed at checkout). Your use of the Service is also subject to these providers' terms of service and privacy policies.

No Guarantee of Exam Results

SagaDeutsch is a preparation tool. We do not guarantee any particular score, pass rate, or outcome on any official German language exam. Exam-accuracy claims refer to our best-effort alignment with publicly known exam structures. official exam content is owned by the respective certification bodies.

Not a Substitute for Formal Instruction

SagaDeutsch supplements but does not replace formal German language instruction. We are not a certified language school and do not issue CEFR certificates. Any certificate or qualification requires registration and testing with the relevant official body.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. SAGADEUTSCH EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF AI-GENERATED CONTENT, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAGADEUTSCH AND ITS OPERATORS, EMPLOYEES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. INCLUDING LOSS OF DATA, LOSS OF REVENUE, LOSS OF GOODWILL, OR FAILURE TO ACHIEVE EXAM RESULTS. ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Cap on Liability

In any case, our total aggregate liability to you for all claims arising under or in connection with these Terms shall not exceed the total amount you paid to SagaDeutsch in the 12 months immediately preceding the event giving rise to the claim, or USD 50, whichever is greater.

Essential Basis

These limitations reflect a reasonable allocation of risk. SagaDeutsch would not be able to offer the Service on reasonable commercial terms without these limitations. Some jurisdictions do not allow exclusion of certain warranties or limitation of liability. in such cases, the limitation applies to the fullest extent permitted.

You agree to indemnify, defend, and hold harmless SagaDeutsch and its operators, affiliates, employees, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law or third-party right; (c) any content you submit to the Service.

SagaDeutsch shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control. including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, internet outages, cyberattacks, third-party service failures (AWS, Vercel, Cloudflare), or epidemics.

By You

You may stop using the Service and delete your account at any time via your account settings or by contacting us.

By Us

We may suspend or terminate your account and access to the Service immediately, with or without notice, if: (a) you breach these Terms; (b) we are required to do so by law; (c) we discontinue the Service.

Effect of Termination

Upon termination, your licence to use the Service ends immediately. Sections on Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law survive termination.

Governing Law

These Terms are governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law principles.

Jurisdiction

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Nepal, except where mandatory consumer protection laws in your jurisdiction grant you the right to bring proceedings in your local courts.

EU & EEA Users

If you are a consumer located in the EU or EEA, you retain the benefit of any mandatory consumer protection provisions of the law of your country of residence that cannot be contracted out of, including online dispute resolution rights. EU users may use the European Commission's Online Dispute Resolution platform.

Dispute Resolution

Before initiating formal legal proceedings, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will attempt in good faith to resolve any complaint within 30 days.

Entire Agreement

These Terms, together with the Privacy Policy and any other policies linked herein, constitute the entire agreement between you and SagaDeutsch regarding the Service and supersede all prior agreements.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.

No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

Language

These Terms are written in English. If they are translated into another language, the English version prevails in the event of any conflict.

We may update these Terms from time to time. We will notify you of material changes by email and/or a prominent notice on the platform at least 14 days before they take effect. The updated Terms will show a revised effective date. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not accept the changes, you must stop using the Service and may delete your account.
